1. Acceptance of Terms

By accessing or using Sim2Course Golf ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Sim2Course Golf provides golf-performance, course-planning, caddie, practice, round-play, and post-round tools. Depending on feature availability, users may import or enter shot data; create and play rounds on satellite, aerial, map, or rendered course views; record GPS or manually selected shot and target points; view distances, elevation, weather effects, overlays, hazards, dispersion, and estimated outcomes; receive club and strategy recommendations; and generate caddie booklets or round recaps.

3. Account Registration

You must provide accurate, current, and complete registration information, including a working email address used to sign in, verify requests, recover access, and receive essential account notices. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 13 years old to use the Service.

4. Subscriptions & Payments

Free Tier: A free account includes CSV import, raw shot data, filtering, shot analytics, the 3D range, the smart golf bag, leaderboards and friend comparisons. These are free and are not time-limited.
Pro Subscription: The Live Course Caddie requires a paid Pro subscription — GPS targeting at a real course, effective yardage, and the conditions and club guidance that go with it. In the current app, a live round on a real course is the only subscriber-only feature; imports, analytics, shot history, the practice range and the bag are free.
Free Trial: Eligible new accounts may start a 14-day free Pro trial. The trial is started by you from within the app rather than applied automatically, no payment method is required, and it is available once per account.
Billing: Subscriptions are purchased in the iOS app and billed in advance through the Apple App Store, or purchased in the Android app and billed in advance through Google Play. Two plan sets are offered. Accounts subscribing on the original plans pay $0.99/month or $9.99/year (about $0.83/month, save about 16%). Accounts subscribing on the current plans pay $2.00/month or $16.00/year (about $1.33/month, save about 33%). The plan and price you are charged are shown before you confirm the purchase and on your subscription page. An existing subscription is never moved between plan sets: the price you subscribed at is the price you keep for as long as that subscription renews. All fees are in USD and non-refundable except as required by law. The actual purchase amount is confirmed by Apple or Google.
Cancellation: You may cancel your subscription at any time. Access to Pro features continues until the end of the current billing period. No partial refunds are provided.
Price Changes: We reserve the right to change the price of any subscription, including to increase it, at any time. If we increase the price of a subscription you are already paying for, we will give you at least 30 days' advance notice before the increase takes effect. That notice will be shown to you inside the app on every device the app supports, and will state the subscription affected, the current price, the new price, the date the new price first applies, and how to cancel. Apple and Google will also notify you separately in accordance with their own rules, and in some cases will ask you to confirm the new price before it can be charged. No price increase will ever affect a billing period you have already paid for. If you do not want to continue at the new price, you may cancel at any time before the effective date and you will keep access until the end of the period you have already paid for. If you do not cancel and your subscription renews on or after the effective date, that renewal is at the new price. We may also choose to keep existing subscribers at their current price when prices rise; where we do, we will say so in the notice.

5. User Content & Data

You retain ownership of shot data, round records, club configurations, coordinates, notes, images, and other content you submit or create through the Service ("User Content"). You represent that you have the rights and permissions needed to provide that content. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transform, display, transmit, and process User Content only as reasonably needed to operate, secure, support, and improve the Service and to create the maps, calculations, recommendations, booklets, recaps, and other outputs you request. This license ends when the content is deleted, except for temporary backups and limited records we must retain for legal, security, billing, or fraud-prevention purposes.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose.
Upload malicious code or attempt to disrupt the Service.
Attempt to access other users' accounts or data without authorization.
Reverse engineer, decompile, or disassemble any portion of the Service.
Use automated means to access the Service without our permission.
Scrape, download, bulk-cache, trace, extract, copy, or redistribute third-party imagery, map tiles, elevation data, course data, or other provider content except as expressly permitted by the applicable provider and law.
Remove, obscure, or alter copyright, trademark, attribution, source, or license notices displayed with maps, imagery, data, or other content.
Upload scorecards, course images, logos, or other materials unless you have the right to use and submit them.
Use shot, target, path, or measurement overlays to create or distribute a substitute imagery or map dataset.

7. Maps, Location, and Course Information

Location-enabled features may use your device GPS, points you select on satellite or aerial imagery, or both. The Service may store those points with shot and round records and use them to calculate distances, elevation, weather effects, paths, overlays, hazard positions, and recommendations. You control whether to grant device-location permission, but some features may be unavailable or less accurate without it.

Maps, imagery, elevation, weather, and geographic or course data may be supplied by third parties, including Mapbox, OpenStreetMap contributors, USGS, and USDA programs, and remain subject to their applicable rights, licenses, terms, and displayed attribution. Your right to use the Service does not grant you ownership of or a separate license to copy or redistribute provider content. User-created shot, target, pin, path, ring, dispersion, measurement, and similar overlays are separate from the underlying provider content.

Course names, hole numbers, yardages, pars, hazards, and similar facts are used for identification and informational purposes. A course listing does not mean that Sim2Course is affiliated with, sponsored by, endorsed by, or authorized by the course or its operator. Map positions, boundaries, distances, elevations, weather, hazards, score estimates, and recommendations may be incomplete, delayed, or inaccurate. Always follow posted course rules, signs, staff instructions, and actual conditions.

8. Intellectual Property

The Service, including its design, code, graphics, AI models, and branding (excluding user content), is owned by Sim2Course Golf and protected by copyright, trademark, and other intellectual property laws.

9. Third-Party Trademarks

Sim2Course Golf is an independent software tool and is not affiliated with, endorsed by, sponsored by, or an official product of any golf course, course operator, tournament, mapping or data provider, launch-monitor manufacturer, or golf-equipment company. All product names, logos, brands, and trademarks mentioned on the Service — including but not limited to TrackMan, Foresight Sports, GCQuad, GC3, Bushnell, Launch Pro, FlightScope, Mevo, SkyTrak, SkyTrak+, Garmin, Approach R10, Rapsodo, MLM2PRO, Uneekor, Full Swing, KIT, Square Golf, Awesome Golf, Titleist, Callaway, TaylorMade, and Ping — are the property of their respective owners. References to course names and third-party names are for identification, compatibility, and informational purposes only and do not imply affiliation, sponsorship, authorization, or endorsement. All third-party names, logos, brands, and trademarks remain the property of their respective owners.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that maps, imagery, GPS positions, course information, boundaries, distances, elevations, weather, hazards, club or strategy recommendations, score estimates, visualized trajectories, or other calculations are complete or accurate; that any recommendation will improve performance; or that the Service will be uninterrupted, secure, or error-free. Do not rely on the Service for safety-critical navigation. Verify conditions and comply with course rules and staff instructions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIM2COURSE GOLF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your account for violating these Terms. You may delete your account through the in-app Delete Account control or request deletion from your registered email address. Upon termination, your right to use the Service ends. App-owned account content is deleted within 30 days after a verified request, subject to temporary backups and limited subscription, transaction, security, account-integrity, dispute, legal-compliance, and fraud-prevention records described in the Privacy Policy. Device-only cached information may remain until you clear storage or uninstall the app.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Harris County, Texas.

14. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via email or in-app notice. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Apple App Store Terms

If you downloaded the Service from the Apple App Store, the following additional terms apply and take precedence over any conflicting terms above:

This Agreement is between you and Sim2Course Golf only, not with Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.
Apple has no obligation to furnish any maintenance or support services for the Service.
In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service to you, if any; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Service.
Apple is not responsible for addressing any claims by you or any third party relating to the Service, including product liability claims, claims that the Service fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.
